Pre-Order Terms and Conditions

1. Offer Overview
1.1 This offer ("Offer") is open to all customers who pre-order a Thermal Dawn system through the official website or approved promotional channels.
1.2 Customers may select between the Basic Reserve ($199) or Founder Premium ($990) options as listed on the website or as otherwise agreed in writing.
1.3 Each option provides a pre-order benefit and discount as described online at the time of purchase, including but not limited to percentage discounts, extended warranty, community access, and service benefits.
1.4 Discounts apply to the standard Thermal Dawn retail price (RRP) as advertised or as otherwise agreed in writing.
1.5 The standard Thermal Dawn system price typically ranges between $8,000 and $18,000, depending on home size, configuration, and installation needs.
1.6 Any pricing discussed in emails, conversations or promotional materials prior to a formal installation quote is indicative only and subject to change. The formal installation quote issued to you is the binding price.
2. Deposit & Reservation
2.1 A deposit payment (either $199 or $990) is required to secure a reservation in the Thermal Dawn pre-order program.
2.2 The deposit is fully refundable until a build slot is allocated or a formal installation quote is issued.
2.3 Once a customer accepts a formal installation quote, the deposit will be applied toward the final invoice.
2.4 If a customer chooses not to proceed before accepting the quote, or if Thermal Dawn determines installation is not feasible, the deposit will be refunded in full.
2.5 Pre-order availability is limited and may close once the advertised capacity is reached.
3. Eligibility & Installation
3.1 The Offer is available only to residential property owners within Thermal Dawn's service areas, as advised at the time of enquiry.
3.2 Thermal Dawn will conduct a suitability assessment or site inspection before confirming installation. If installation is not feasible due to property conditions, the deposit will be refunded in full.
3.3 Installations are underway and ongoing. Scheduling is based on system readiness, regional rollout, and production availability. Customers will be contacted to confirm their installation timeline.
3.4 Customers will receive a formal installation proposal before full payment and installation. At that stage, a new set of Terms & Conditions will apply.
3.5 The deposit becomes non-refundable once the customer agrees to proceed with the final quoted installation.
4. Payment, Refunds & Cancellation
4.1 The applicable pre-order discount will be applied to the final invoice once installation details are confirmed.
4.2 Customers may cancel their pre-order and request a full refund at any time prior to accepting the formal quote.
4.3 To request a refund, customers must email nick@thermaldawn.com.au. Thermal Dawn will acknowledge and process refund requests within 10 business days.
4.4 If Thermal Dawn determines installation is not possible, the full deposit will be refunded.
4.5 Refunds will be issued using the same payment method originally used.
5. General Terms
5.1 This Offer is non-transferable and cannot be combined with other promotions unless agreed in writing.
5.2 Thermal Dawn reserves the right to modify, extend, or withdraw this Offer at any time without notice. Deposits already received will continue to be valid or refunded as applicable.
5.3 Installations are subject to a satisfaction guarantee, details of which will be provided in the formal installation agreement.
5.4 Certain consumer protections, including rights under the Australian Consumer Law, apply and cannot be excluded. Nothing in these Terms limits those rights.
5.5 By submitting a pre-order or deposit payment, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
6. Dispute Resolution & Governing Law
6.1 These Terms & Conditions are governed by the laws of New South Wales, Australia, and any disputes shall be subject to the exclusive jurisdiction of the NSW courts.
6.2 Before commencing any formal proceedings, both parties agree to attempt to resolve any dispute through good-faith discussions within 10 business days of notice.
6.3 If unresolved, the dispute may be referred to mediation administered by the Australian Disputes Centre.
